Man charged with crime for making "gang gestures" on MySpace page

It's about time! Lee, County Florida is charging these two people under a new Florida state law that criminalizes the use of electronic media to "promote gangs."

Baytzim.com was the lone voice in this matter when a person who has clear ties to gangs, judging from his gestures on his MySpace page, was caught smuggling guns onto an airplane. Nobody seemed to care about this.

But Florida, which has little regard for minor annoyances like our "Constitution" and our "First Ammendment" is bold enough to do something about this horrible electronic threat!

LEE COUNTY — Elvis Rodriguez, 30, flashed Latin Kings hand signals on his MySpace.com page and called himself “King Kamel,” according to his arrest report.

Richard Figueroa-Santiago, 22, used his MySpace page to post pictures of friends making “Eastside” hand gestures, detectives said.

Now, in the first cases of their kind in Florida and in the nation, both Lee County men face five years in state prison for the gang-related content of their Web pages.

Their prosecutions are the first under a state law passed last year that criminalizes the use of electronic media to “promote” gangs.

Attorneys for both are challenging the law as unconstitutional.

“It violates his right to free speech, to associate,” said Joseph Cerino, Rodriguez’s lawyer.

The bill’s sponsor, a retired police officer, calls the law a modern response to increasing gang violence in some Florida cities.

Wow... I just love this. So much for first amendment rights! A purely virtual display of a symbolic gesture that 99.9% of people would never identify is enough to nab you 5 years. So in theory, if you make a crazy hand gesture in your online photo album and some random govt. agency mis-interprets that as a 'gang sign' you are going to jail! Be sure to keep your hands out of view of all cameras in the future!
So the Constitutional muster for this is laughable. Whos' rights exactly were violated by this photo on MySpace? Were people murdered and raped in the streets simply because this photo was made available online? Not likely. Gang members perpetrate actual crimes last time I checked... let's try putting them in jail for that instead of what color they wear or their hand gestures. This is more 'mind-crime' legislation like 'hate-crime' laws that seeks to make thoughts and beliefs illegal and not actions we typically associate with crime. In light of this... I think we should follow thru and make all crosses and religious symbolism illegal because of all the abortion clinic bombings it 'might' prevent.
